Israeli cabinet approves deal to release Gilad Shalit... meanwhile... everything is murky out there.
Media_httpwwwyoum7com_qcfgu Denied, Palestinian sources from within the Islamic Resistance Movement, Hamas, the "seventh day" as reported on the German news agency that Egyptian security source confirmed that the Israeli soldier Gilad Shalit arrived to Cairo via the Rafah crossing on Tuesday evening. The Palestinian source said that Shalit had not been handed over to Cairo, so far, noting that a large delegation of the leadership of the movement led by Khaled Meshaal, will arrive today, Wednesday and that he can not deliver the prisoner, prior to finalizing and arrange delivery.
Whatever that means? I have no idea... but does it matter? Sky News (That is FOX NEWS) says Gilad Shalit was captured in Gaza.

The United States has stopped a 'significant terrorist act linked to Iran which wanted to assassinate Saudi Arabia's ambassador in Washington DC, as well as other attacks.
The assassination of Adel Al-Jubeir would have been followed by bomb attacks on the Saudi and Israeli embassies in Washington.
The plot has support from the Iranian government and two men allegedly working for 'factions of the Iranian government' have been charged with the plot, Attorney General Eric Holder said Tuesday.
The criminal complaint, unsealed on Tuesday, identifies the two alleged plotters as Manssor Arbabsiar and Gholam Shakuri. Arbabsiar was arrested on September 29 in New York, according to Holder, was working for the Iranian Islamic Revolutionary Guard and had confessed to a plot. Shakuri, who is based in Iran, remains at large. The case, called Operation Red Coalition, started in May when an Iranian-American from Corpus Christi, Texas, sought help for the assassination from a Mexican drug cartel and inadvertently approached a US informant. The FBI and DEA were involved in unravelling the plot.

Richard Silverstein WASHINGTON — FBI intercepts leaked by an Israeli employee of the agency has provided evidence of intensive monitoring of the Jewish state by the U.S. intelligence community.  The U.S. intelligence campaign against Israel was highlighted by intercepts supplied by an FBI translator to U.S. blogger Richard Silverstein who said the FBI bugged the Israeli embassy in Washington and intercepted discussions with members of Congress and the pro-Israel lobby. Silverstein acknowledged that he received 200 pages of transcripts of telephone calls to and conversations in the Israeli embassy. Later, Silverstein said he burned the transcripts.

Amina Mona will be back out there! Gentlemen take care

So Gilad gets his freedom for the first time in five years and decided he wants to get laid. He calls up an escort agency and says... man I need to get some action. What girl can you send me? The escort agency says... "Amina"! Gilad Shalit says, "Amina? ...Amina who?". "Amina Mona", says the woman on the phone.
...Abbas also handpicked five female recipients for the highest medal of heroism. Among them Amina Mona who lured 16-year-old Israeli Ofir Rahum via Internet chats to a cruel death. Without telling anyone, Ofir put on his best clothes and took the first bus he could. The girl came to pick him up in Jerusalem. The Israeli boy didn’t even realize when the car entered Ramallah. It is difficult to describe what the Palestinians did to him. He was Jewish, poor, naïve and innocent.

Syria’s Grand Muft Shiekh Ahmad Badreddin Hassoun said suicide bombers in the West are ready to respond to any military action against Syria.

(AlArabiya) “I say this to all of Europe, and I say this to America: We will prepare suicide bombers, who are already in your country, to strike you if you strike Syria or Lebanon. After today, an eye for an eye and a tooth for a tooth and the initiator is the aggressor.”“After the first rocket hits Syria, Lebanese and Syrian children will set off for Europe and Palestine, where they will be martyrs.”

Backstabs to Syria and Radar Deal Triggers Benefits in Weaponry for Turkey

Turkey is playing us well. The have their chips all in the right place at the right time. Friends with Syria in fair weather and then a backstab... in fact it appears that Ankara is planning a Syrian overthrow of Assad.
Al-Asaad (not Bashar al-Assad) is now staying in a refugee camp in the southern province of Hatay after escaping from his post in the Syrian Air Force in July. Nearly 7,608 refugees are currently sheltering in Turkish camps along the border with Syria. The number of military defections in Syria is increasing, said al-Asaad, who is the leader of a group of similar defectors that are now calling themselves the Free Syrian Army. "Right now there are more than 10,000 defectors in the Free Syrian Army, and the number is increasing day by day," al-Asaad said. "Defecting soldiers are setting up ambushes against government forces to prevent them from entering the villages."
(AlArabiya) Formed in Istanbul at the end of August, the Syrian National Council unites all the major known factions opposing Assad’s rule, both inside and outside Syria. It includes the Local Coordination Committees, an activist network spurring protests in Syria, the long-banned Muslim Brotherhood as well as Kurdish and Assyrian groups. The formation of the council has been welcomed by Western countries including the United States and France. However, unlike the transitional council set up by Libyan rebels who overthrew Muammar Qaddafi, they have not offered it any formal recognition.
Erdogan is cooperating with a NATO missile shield in exchange for weapons that he will use against his Kurds and will use against the Jews in Israel. This appears to be upsetting the Iranians.
Rahim-Safavi said trade ties with Turkey -- which is an importer of Iranian gas and exporter of an array of manufactured goods -- would be in jeopardy if Ankara does not change its course.
"If Turkish political leaders fail to make their foreign policy and ties with Iran clear, they will run into problems. If, as they claim, they intend to raise the volume of contracts with Iran to the $20 billion mark, they will ultimately have to accommodate Iran."
...but Turkey isn't scared of Iran. Iran needs Turkey more then Turkey needs Iran... and Turkey is benefitting by unscrupulous dealings between Iran and NATO. There is no incentive for this behavior to stop
Turkey has already started to see the benefits of its decision to host a special radar for NATO's planned missile shield as the United States promised to transfer three AH-1W Super Cobra attack helicopters to Ankara's control for use against the outlawed Kurdistan Workers' Party, or PKK. U.S. Ambassador to Ankara Frank Ricciardone told reporters Sept. 30 that the U.S. had agreed to transfer three AH-1Ws to the Turkish military to be used in the fight against the PKK.
They had some before, but relations were rocky.

Iran_already has expressed its ire against Turkey," said an Ankara-based defense analyst familiar with U.S.-Turkish relations. "So something more is expected to come from the United States, probably in terms of equipment and in political support." Turkish Prime Minister Recep Tayyip Erdoğan recently announced that a number of MQ-1 Predator drones would also be acquired from the U.S.; Turkey had asked for both unarmed and armed versions of the Predator nearly three years ago. The MQ-1 Predator is mainly the surveillance version, and the MQ-9 Reaper is the armed version.

California Governor Veto Allows Warrantless Cellphone Searches

Labels: » » » » » » »
California Gov. Jerry Brown is vetoing legislation requiring police to obtain a court warrant to search the mobile phones of suspects at the time of any arrest. Because of that January ruling from the state’s high court, the California Legislature passed legislation to undo it — meaning Brown is taking the side of the Supreme Court’s seven justices instead of the state Legislature. The U.S. Supreme Court denied cert last week in Diaz v. California, a Fourth Amendment case from California’s Supreme Court which held that a cell phone can be searched incident to arrest. The Assembly approved the bill 70-0 and the state Senate, 32-4. The bill’s sponsor, Sen. Mark Leno (D-San Francisco), was flummoxed by Brown’s action. “It was a curious veto message suggesting that the courts could resolve this more effectively than the state Legislature,” he said in a telephone interview. Under California statehouse rules, neither Leno nor any other lawmaker may introduce the legislation for at least a year.
Northrop v. Trippett (6th Cir. 2001) 265 F.3d 372, 379: When conducting a search incident to arrest, police may search items within the “immediate control” of the person arrested.
(Wired) Cops Need Warrant for Cellphone Location Data, according to Judge Terrence McVerry of the Western Pennsylvania U.S. District Court on September 11, 2008. The Obama administration’s position that the government can force mobile carriers to hand over cellphone tower location information on their customers without a warrant is wrong, two legal scholars say. scholars Susan Freiwald, of the USF School of Law, and Peter Swire, of Ohio State University wrote: "Because CSLI acquisition is hidden, indiscriminate and intrusive, and because it reveals information over a period of time, it should be subject to the highest level of Fourth Amendment oversight (the same procedures used for wiretapping and video surveillance)," Their words, published by the American Constitution Society, came a month after the Justice Department made its claim in a little-noticed case that the Fourth Amendment right to be free from unreasonable searches and seizures did not apply. In April 20, 2009 Scholars Rejected Obama’s Stance on Warrantless Cell-Phone Records

Northrop v. Trippett (6th Cir. 2001) 265 F.3d 372, 379: When conducting a search incident to arrest, police may search items within the “immediate control” of the person arrested. Id. at 763, 89 S.Ct. 2034. The Supreme Court has construed the area within a person’s immediate control to include the “area from within which he might gain possession of a weapon or destructible evidence.” Id.
However, the right to search an item incident to arrest exists even if that item is no longer accessible to the defendant at the time of the search. So long as the defendant had the item within his immediate control near the time of his arrest, the item remains subject to a search incident to arrest.
